Terms and Conditions

CONTRACT PRICE AND PAYMENT

Owner shall pay the agreed upon listed price in the space marked “Total”, which is the total flat price for the work to be performed.

Payments will be in two parts; a deposit and final work completed. The down payment deposit shall be received now in the amount of $1,000.00 or 10% of the total price, whichever is less. The remainder of the total cost will be due upon the completion of the installation.

If a check is returned or card refunded, Owner is liable for the payment and any charges from the bank. In the event that collection efforts are initiated, Owner shall pay for all associated fees including attorneys fees and collection costs.

Copperline pricing is set for general installation conditions and does not include any additional work for potential code compliance specifications. The homeowner is responsible for additional charges if a permit is required and code compliance modifications to home are necessary.

RIGHT OF CANCELLATION

Three Day Right to Cancel: You, the Owner, have the right to cancel this agreement within three business days. You may cancel by e-mailing, mailing, or delivering a written notice to Copperline LLC by midnight of the third business day. If you cancel, you will receive the deposit returned within 10 days of Copperline receiving the notice of cancellation.

CONTRACTOR

Installation: All products purchased through Copperline LLC are installed by an independent licensed Contractor. All installation Contractors are guaranteed to be reputable and in good standing with the CSLB.

Guarantee: Contractor will furnish all labor, parts, and equipment to complete installation in a good and workmanlike conduct.

Insurance: Contractor will carry commercial general liability insurance and workers’ compensation insurance for all employees.

Change Orders: Any changes to the contract, prior or during the install, must be prepared in writing and signed by the parties prior to commencement of any work covered by the new change order.

Extra Work: Additional work performed or items installed outside of this scope of work shall be solely between the Owner and Contractor. Copperline LLC will not be compensated nor responsible for any additional work performed or items installed by the Contractor.

Right to Stop Work: Contractor shall have the right to cease work on the project if any safety or hazardous issues arise.

Delay: Contractor shall be excused for any delay due to any of the following events provided that such event is beyond the reasonable control of Contractor: (1) acts of God including but not limited to wind, rain, flood, storm, landslide, subsidence and earthquake; (2) acts of neglect of Owner; (3) delays caused by work which is not the responsibility of Contractor; (4) acts of neglect of separate contractors employed by Owner; (5) delays caused by public utilities or government or public bodies or their agents; (6) material embargoes; (7) labor troubles, labor slow down, strikes, union activity causing reduction in productivity; (8) fire; (9) transportation delays; (10) changes ordered in the work; or (13) other causes beyond the reasonable control of Contractor.

WARRANTY

Parts are covered under a 5 year manufacturers warranty. However the warranty does not cover misuse of plumbing nor negligence from the Owner.

All warranty's are non transferrable. If the homeowner sells the home or transfers ownership then the warranty is null and void.

To warranty the product, Owner must make available access for a Contractor to either; fix, replace or remove the product, whichever is agreed upon.

TERMS AND CONDITIONS

Property Insurance: Owner shall maintain property insurance until final payment is due. Property insurance shall cover the amount of the total sum of the work at the site. If the project, or any portion thereof, is destroyed or damaged by accident, disaster or calamity resulting from any cause, including the negligence of Contractor, Copperline LLC shall nevertheless be paid for all work completed or work in progress as of the date of the calamity by the Owner’s all-risk policy. At the option of Owner, this project may be terminated under such circumstances, or rebuilt with appropriate adjustments for price, scope of work and schedule.

Waiver of Subrogation: The Owner and Contractor waive all rights against each other for damages caused by fire or other causes of loss to the extent covered by property insurance applicable to the work, except such rights as they had to proceeds of such insurance held by the Owner as fiduciary. Policy shall provide such waivers of subrogation by endorsement or otherwise.

Permits: Property Owner shall obtain and pay for all required building permits. Owner shall be responsible for all taxes, assessments and charges required by public agencies, unless otherwise noted in contract.

Bankruptcy: If either party files for Bankruptcy or makes an assignment for creditors, the other party has the right to cancel this Agreement.

Attorneys’ Fees: In any dispute relating to the interpretation or enforcement of this project, the prevailing party shall be entitled to its costs and attorneys’ fees.

Mechanics Lien: If Copperline LLC has to issue a mechanic's lien against the Owner for nonpayment, a $300 mechanic's lien fee will be added to the total amount collected.
